BY SUBMITTING YOUR TICKET AT CHECK-IN, YOU ARE AGREEING TO THE FOLLOWING LIABILITY WAIVER
This is a legally binding Release, Waiver, Discharge, and Covenant Not to Sue (collectively, “Release”), made voluntarily by me, the ticket holder, on my own behalf, and on behalf of my heirs, executors, administrators, legal representatives, and assigns (hereinafter collectively, “Releasor”, “I”, or “me”) to the TRI SPORTS Social Club’s Raleigh St. Pat's Pub Crawl
taking place on March 18, 2017.
As the ticket holder, I fully recognize that there are dangers and risks to which I may be exposed by participating in this event, the TRI SPORTS Social Club’s Raleigh St. Pat's Pub Crawl. As the Releasor, I understand that TRI SPORTS Social Club does not require me to participate in this event, but I want to do so despite the possible dangers and risks and despite this Release.
These risks include, but are not limited to the following: the risks associated with travel to and from locations to be visited during the TRI SPORTS Social Club’s Raleigh St. Pat's Pub Crawl, including transportation provided by commercial, private, and/or public motor vehicles; intoxication and/or alcohol poisoning from the alcohol I consume whether
voluntarily or through coercion; the possibility of bodily injury including soft tissue, broken bone or dental damages from falling down, injuries incurred while getting on or off (in or out of) the mode of transportation being used, being knocked down or being involved in a physical confrontation whether caused by myself or someone else; and/or the risks associated with returning to my residence.
I agree to assume and take on myself all the risks and responsibilities in any way arising from or associated with this event, and I release TRI SPORTS Social Club and all of its committees and groups, and their respective governing boards, officers, directors, principals, trustees, legal representatives, members, owners, employees, agents, administrators, assigns,
and contractors, as well as participating sponsors, non-profit organizations, event partners, and hosts (collectively “Releasees”), from any and all claims, demands, suits, judgments, costs, damages, actions, and liabilities of every name and nature whatsoever, whenever occurring, whether known or unknown, contingent or fixed, at law or in equity, that I may
suffer at any time arising from or in connection with the TRI SPORTS Social Club’s Raleigh St. Pat's Pub Crawl and After-party, including any injury or harm to me, my death, or damage to my property (collectively “Liabilities”), and I agree to defend, indemnify, and save Releasees harmless from and against any and all Liabilities.
As the Releasor, I recognize that this Release means I am giving up, among other things, all rights to sue Releasees for injuries, damages, or losses I may incur. I also understand that this Release binds my heirs, executors, administrators, legal representatives, and assigns, as well as myself. I also affirm that I have adequate medical and health insurance to cover any medical assistance I may require.
I agree that I am of legal drinking age in the State of North Carolina, 21 years or older, and will provide proof with a valid driver’s license or passport.
I agree that this Release shall be governed for all purposes by North Carolina law, without regard to such law on choice of law.
I have read this entire Release. I fully understand the entire Release and acknowledge that I have had the opportunity to review this Release with an attorney of my choosing if I so desire, and I agree to be legally bound by the Release.
TRI SPORTS Social Club reserves all rights to alter scheduled tour itinerary. Registration fees are NOT refundable due to these alterations.
